Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the LaConstructo platform, including the website and mobile application (“Platform”). By accessing, registering, or transacting on the Platform, you agree to be bound by these Terms and related policies.

1. Definitions

• Platform: LaConstructo website and mobile application.
• Buyer / Project Owner: Any individual or entity sourcing construction materials or services.
• Seller / Supplier / Service Provider: Any individual or entity listing products or services on the Platform.
• Agent: An independent referral partner who submits leads only and does not manage orders or projects.
• Logistics Partner: Transporter or courier providing pickup and delivery services.
• NBFC / Finance Partner: Third-party provider offering credit facilities.
• Insurance Partner: Third-party provider of optional transit or project insurance.
• Escrow: A payment mechanism where funds are released upon delivery or acceptance milestones.

2. Acceptance of Terms

By registering, browsing, bidding, listing, or transacting on the Platform, you agree to these Terms along with our Privacy Policy, Refund Policy, and Warranty Policy.

3. Registration & KYC

Registration is mandatory for Buyers and Sellers using email/OTP-based login. KYC or additional verification may be required for certain features such as credit facilities or high-value orders. You are responsible for providing accurate information and maintaining the confidentiality of your account credentials.

4. Marketplace Use

• Product & Service Listings: Sellers must provide accurate descriptions, pricing, availability, certifications, and images. Any misrepresentation may result in suspension or termination.
• Smart Quotation & Live Bidding: Bulk orders may be opened for bidding. Negotiation after receiving a quotation is not permitted; a new requirement must be placed.
• One Quotation per Bid: Only one quotation per bid is supported.
• Bid Closure: Once a bid is accepted or rejected, it cannot be reopened. A new bid must be created.

5. Orders, Pricing & Taxes

• Prices may be dynamic and market-linked. Taxes such as GST are extra unless stated otherwise.
• Orders become binding upon Seller acceptance and payment authorization or escrow confirmation.
• Custom or make-to-order items (such as precast components, fabricated steel, or epoxy mixes) may have special terms including longer lead times and non-cancellability once production begins.

6. Payments & Escrow

• Supported Payment Methods: UPI, NEFT, cards, wallets, and escrow-based gateways such as Razorpay, PayU, and Cashfree.
• Escrow Settlement: Funds are released upon delivery confirmation or as per agreed milestones. Chargebacks or holds may apply according to payment gateway rules.
• Credit Facility: Credit may be offered through NBFC partners. Separate terms apply between the user and the NBFC.

7. Delivery, Logistics & Insurance

• Deliveries may be handled by integrated logistics partners or a transporter selected by you. GPS tracking and ETA updates are provided where available.
• Optional transit insurance can be added during checkout through empanelled insurance partners. Coverage, exclusions, and claims are governed by the insurer’s terms.
• Delivery is deemed complete upon physical handover at the specified address and proof of delivery (POD). Buyers must inspect goods at delivery as per the Refund and Warranty policies.

8. Services Execution (MEP / HVAC / Structural / Finishes)

• Scope, specifications, schedule, milestones, safety requirements, and quality checks are defined in the applicable work order or contract.
• All change orders must be documented and may impact cost and timelines.
• Buyers must provide safe site access, electricity, water, storage space, and required permits where applicable.

9. Agent Program

• Agents act only as referral partners and do not manage orders, projects, or payments.
• Commissions are payable only upon successful conversion and receipt of cleared funds, as per the program rules announced by LaConstructo.
• Misuse such as spam, misrepresentation, or unauthorized commitments may result in termination and forfeiture of commissions.

10. User Conduct

Users must not engage in illegal activities, intellectual property infringement, price fixing or collusion, fraud, or abuse of bidding and rating systems. Violations may lead to account suspension or termination.

11. Platform Features & Availability

We strive to maintain uptime and accurate functionality, including bidding, alerts, and tracking. However, the Platform may be unavailable due to maintenance or external factors. We may update, modify, or discontinue features with reasonable notice where feasible.

12. Disputes & Resolution

• Users should first contact support via the dashboard or official support channels.
• Platform administrators may intervene in disputes and request supporting documentation such as PODs, inspection reports, photos, or call logs.
• If unresolved, disputes may be escalated as per the Governing Law clause below.

13. Intellectual Property

All Platform content including UI, logos, text, images, and software is owned or licensed by LaConstructo. Users retain ownership of their listings and documents but grant LaConstructo a limited license to host and display such content for marketplace operations.

14. Limitation of Liability

To the maximum extent permitted by law, LaConstructo shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, business interruption, or data loss arising from Platform use, logistics delays, third-party services, or force majeure events. LaConstructo’s aggregate liability shall not exceed the fees received for the transaction giving rise to the claim.

15. Indemnity

You agree to indemnify and hold LaConstructo harmless from any claims, losses, or damages arising from your breach of these Terms, violation of law, or infringement of third-party rights.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts located in Jaipur, Rajasthan shall have exclusive jurisdiction.

17. Changes to Terms

We may update these Terms from time to time. The revised version will be posted with an updated effective date. Material changes may be notified where feasible.
